Sale and Purchase Agreements (S&P) in Thailand:
What Foreign Buyers Need to Review Carefully

The Sale and Purchase Agreement (S&P) governs every stage of a property transaction in Thailand. For foreign buyers, signing this agreement without legal review is one of the most common sources of disputes...

Can foreigners buy property in Thailand?

Foreign nationals are permitted to own condominium units on a freehold basis, provided that foreign ownership in the project does not exceed 49% of the total saleable area. This is currently the most secure and commonly used option.

Foreigners are not permitted to own land freehold in their own name. Attempts to bypass this rule through nominee arrangements or informal agreements carry significant legal risks.

Alternative structures

Some buyers consider:

  • Long-term leasehold arrangements
  • Properly structured company ownership (subject to strict legal compliance)

Each option requires careful legal assessment to ensure compliance with Thai law.
